Terms of Service

These Terms of Service ("Terms") are a contract between you and Siyu Zhang, an individual developer operating DiShu ("DiShu," "the app," or "the Service"). By using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. Eligibility and Age Check

You must be at least 16 years old, or older if the law where you live sets a higher minimum age for a service like DiShu. By creating an account, you confirm that you meet this requirement.

To enforce it, every time you sign in the app asks Apple for the age range declared for the Apple Account on your device (under 16, 16 to 17, or 18 and over, and how that range was declared), whichever sign-in method you use. We never receive your date of birth. If no age range is shared, or the range is under 16, we do not create an account or sign you in. If an existing account is found to belong to someone under 16, we close it and schedule it for deletion as described in the Privacy Policy. Our age rule is explained at dishu.link/age-suitability.

Your content. You retain ownership of the notes you create. Notes are either composed from our vocabulary of phrases and words or, where that option is available, written freely. A note cannot be edited after it is published; you can delete it at any time.

License you grant us. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content within the app, solely for the purpose of operating the Service (including showing it to other users near the location where you placed it). This license ends when you delete your content, except as described in the next paragraph.

Content after account deletion. When you delete your account, your profile information is removed and the notes you created are reattributed to a generic "Deleted User" so they remain visible at their location without identifying you. The license above continues solely for that purpose. If you want specific notes permanently removed before deleting your account, please remove them first from within the app or contact us.

Content guidelines. You agree not to post content that:

We reserve the right to remove content that violates these guidelines and to suspend or terminate the accounts of repeat offenders.

4. Reporting, Blocking, and Content Moderation

Reporting. You can report a note or an account that you believe violates these Terms or the law from within the app, by choosing a reason and, if you wish, adding a comment. A note you report will not be shown to you again, whatever the outcome.

How we moderate. We handle every report the same way:

Blocking. You can block other users at any time. A block hides their content from you and your content from them, in every part of the app, and neither of you is told that a block is the reason. You can unblock them at any time from Settings.

5. Copyright Notices (DMCA)

If you believe content in the app infringes your copyright, send a notice to support@dishu.link containing:

We will respond to valid notices and may remove content that is the subject of a complaint. The accounts of repeat infringers may be terminated. If you believe your content was wrongly removed, you may submit a counter-notice to the same email address.

6. Location Data

The app requires access to your precise location to function. Each note is anchored to the exact spot where you create it, including its altitude and, if you choose to add it, the direction you were facing. A public note can be discovered by anyone using DiShu near that spot and is shown to them at its exact location, both on the map and as coordinates, together with a place name looked up for that spot. A note you mark "Only me" is visible to you alone.

Please do not place public notes at locations you wish to keep private, such as your home, your workplace, or any place where you do not want others to know you have been. Make the note private instead, or do not create it there.

8. Intellectual Property

The app, its design, code, branding, and the curated word lists used in templated notes are our property or licensed to us. Except for the content you create, you may not copy, modify, distribute, or create derivative works of any part of the app.

9. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (to the maximum extent permitted by law) warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the app will be available at all times, free from errors, or that user-generated content is accurate, safe, or lawful. Content placed at real-world locations does not imply endorsement of, or association with, those locations or the people who own or use them.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunities, arising from your use of the app — even if we have been advised that such damages were possible.

Where liability cannot be excluded by law, our total liability for any claim arising out of or relating to these Terms or the app is limited to AUD 100 or the amount you have paid us in the 12 months before the claim, whichever is greater.

Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot lawfully be excluded or limited under applicable consumer-protection law (including, for users in Australia, rights under the Australian Consumer Law).

11. Indemnification

You agree to indemnify and hold us harmless from any third-party claims, damages, or expenses (including reasonable legal fees) arising from (a) content you post in the app, (b) your violation of these Terms, or (c) your violation of another person's rights. We will give you reasonable notice of any such claim and reasonable cooperation in defending it.

12. Termination

By you. You can stop using the app at any time and delete your account from the Settings screen.

By us. We may suspend or terminate your access at any time for material breach of these Terms (for example, violations of the content guidelines, prohibited use, or repeat infringement), without prior notice. For other reasons, we will provide reasonable notice where practical.

The following sections survive termination: 3 (license to display anonymized content after deletion), 8 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 14 (Governing Law), and any other section that by its nature should survive.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will give you reasonable notice within the app or by email before the changes take effect. Continued use of the app after changes take effect constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of Australia, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the app will be resolved in the courts of Australia, except where local consumer-protection law gives you the right to bring a claim in the courts of your home jurisdiction.
